I thought my tree was private, but unfortunately it wasn't, and this person comes along and takes those pics for her tree, refusing to take them down, even when told, I only wanted to use them in my private tree.. I had only just added them 2 weeks earlier.. If it's still in copyright, the photographer or their heirs own the copyright and by putting a watermark on it and publishing it online without permission, you'd be violating copyright. If the copyright has expired, then you're free to apply a watermark if you'd like, but it doesn't make you the copyright holder - people are still entitled to do what they want with it too because no one owns it. The point is, in that case, you have no claim of ownership because no one does. If the photographer for a photo that old can not be determined (and therefore neither can the copyright status), it's unlikely anyone will come after you for copyright infringement. The heirs of the photographer would have to have negatives or other proof that their ancestor was the photographer and happen to find you posting them online, and take an issue with it.
